What’s Holding Up the CLARITY Act?
Several Senate Democrats, even those generally supportive of cryptocurrency like Angela Alsobrooks and Ruben Gallego, have withheld backing due to concerns about ethics oversight, developer protections, and measures against illicit finance. The Blockchain Regulatory Certainty Act (BRCA) component of the bill aims to formalize existing Treasury policies stating that non-custodial developers have no registration requirements under the Bank Secrecy Act, which Bessent argued was a straightforward clarification rather than a new burden.
Efforts to resolve the ethical concerns are ongoing; Senators Thom Tillis (R-NC) and Ruben Gallego (D-AZ) reportedly agreed on an inclusion defining the role of state attorneys general in oversight, addressing Democrats’ demands that ethics investigations not fall solely under the Department of Justice. Yet with just a week before the Senate’s August recess, whether this compromise will secure enough votes remains uncertain.
Republican Support and Market Response
Republican backing for the CLARITY Act is strong but not unanimous. Pro-crypto Senator Cynthia Lummis confirmed that figures like Josh Hawley resist the bill, suggesting it won’t pass without at least 11 Democratic votes. Meanwhile, President Trump’s focus on other priorities like the ‘SAVE America’ Act could further complicate timely passage.
The crypto market has taken note. Early Friday saw optimism about the bill plummet to a yearly low of just 27%, reflecting skepticism about the CLARITY Act’s chances in the Senate this session. The ongoing tug-of-war over regulatory clarity coincides with broader political maneuvering, leaving the future of American crypto legislation hanging by a thread.
