A Manhattan federal judge refused to toss out Reddit’s claims that Perplexity and its partner SerpAPI bypassed technological barriers designed to protect copyrighted Reddit posts. Judge Upholds Key Anti-Circumvention Claims
U.S. District Judge Paul A. Engelmeyer ruled that Reddit’s core Digital Millennium Copyright Act (DMCA) claims against Perplexity and SerpAPI stand firm. The DMCA forbids circumventing digital protections on copyrighted material, and Reddit argues that Perplexity and SerpAPI did just that by using techniques like rotating IP addresses to dodge Reddit’s and Google’s safeguards. This allowed them to scrape user posts at scale, feeding the AI’s answers with scraped content.
Judge Engelmeyer emphasized that Reddit’s platform qualifies as the type of "global digital online marketplace for copyrighted works" the DMCA aims to protect. He also tentatively accepted that Google’s SearchGuard software counts as a "technological measure" restricting access to protected content. However, not all claims survived. The judge dismissed allegations accusing SerpAPI of trafficking in circumvention tools and rejected Reddit’s unfair-competition and unjust-enrichment claims, narrowing the battle to digital access circumvention.
