The EPA has clarified that certain pollution regulations don’t apply to power plants built exclusively to serve a single facility and disconnected from the public grid. This decision could reshape how data centers and crypto mining operations power themselves, cutting through red tape.
What This Means for Dedicated Power Facilities
The new guidance targets "islanded" power generation facilities plants that operate independently, supplying electricity only to one private customer instead of feeding the public grid. The EPA memo from July 16, signed by Assistant Administrator Aaron Szabo, confirms these setups are exempt from the Acid Rain Program, a law limiting sulfur dioxide (SO2) and nitrogen oxides (NOx) emissions from major power producers connected to the grid.
The Acid Rain Program has served since the 1990 Clean Air Act amendments to curb pollution from large utilities. However, its rules apply only when electricity is sold "primarily for use by the public." The EPA takes a straightforward approach, stating that if a plant powers only its own facility, it falls outside the program’s scope.
For example, a 500 MW natural gas plant proposed to power just one data center equivalent in output to the homes of approximately 375,000 people would avoid Acid Rain Program requirements. Though it still must follow other air quality laws and state regulations, this exemption lowers compliance costs and speeds up project timelines for dedicated power plants.
The EPA has been easing restrictions around data centers throughout 2025 and 2026, streamlining approvals and creating resource hubs to encourage expansion. While the focus has been on AI centers, crypto miners could benefit significantly from reduced regulatory hurdles. Local states still oversee environmental controls, leading to a patchwork of rules depending on location.
This change comes amid rising demand for specialized power infrastructure driven by AI and crypto workloads. By excluding private, off-grid power plants from the Acid Rain Program, the EPA signals a shift toward facilitating energy-hungry operations with fewer barriers.
